With the massive deployment of electric and plug-in hybrid vehicles, many condominiums are considering installing an electric charging station in their car park. Assistance, right to take, collective solution and obligations for syndicates of co-owners: an update on the regulatory framework.
What are the obligations of condominiums for charging electric vehicles?
Adopted in 2019, the mobility orientation law requires developers to pre-equip the car parks of their buildings. This operation consists in having the ducts necessary for the passage of the electrical cables that will serve each place installed. This does not mean that charging stations have to be installed, but that everything must be ready for possible installation. The following are affected by this obligation:
- New buildings
The pre-equipping of all parking spaces is mandatory for condominiums with a car park of more than 10 spaces and whose building permit was filed from March 11 2021.
- Condominiums undergoing major renovation
Condominiums that undertake the renovation of their parking spaces or their electrical installation are concerned by the obligation to pre-equip if the costs of the work are greater than or equal to ¼ of the value of the building.
Finally, each trustee is required to include the issue of installing charging stations on the agenda of a General Assembly before January 1, 2023. During this meeting, the co-owners must decide by vote on the interest of carrying out a study on the work necessary to install charging points.
Good to know : condominiums whose building permit is prior to 2017 are not subject to the pre-equipping obligation. If the condominium refuses to install a charging solution for electric vehicles, an owner or tenant has another recourse: the right to a plug.

Installing a condominium terminal: what solution should you choose?
Several solutions exist to install a condominium charging station for your electric vehicle : the individual terminal for a single occupant or the establishment of a shared infrastructure for the entire condominium. Explanations.
An individual terminal with the right to the socket
Established by decree in 2011, the right to plug allows a tenant or owner to set up, at their own expense, an individual charging station on their parking space. This right was extended in 2021 to apply to covered and enclosed car parks as well as to open or outdoor car parks.
In this situation, the trustee's agreement is not required. The co-owner must nevertheless share his project at an GA with a detailed plan of the work to be carried out. The trustee may oppose the project if:
- the installation of a collective charging solution is planned;
- the installation of an individual terminal is technically impossible;
- the condominium already has a shared charging point.
Although the installation of an individual terminal is possible by connecting the socket to the condominium meter, it is nevertheless considered as a troubleshooting solution. This type of installation requires specific devices in order to establish individual billing for the user of the charging station. In addition, a condominium does not always have a meter powerful enough to charge enough electric cars.
A collective terminal thanks to the ISTA partnership
For co-owners, installing a common charging station (outside or underground) is a wise choice for the future. Why install a condominium charging infrastructure?
Although the installation of a charging infrastructure initially requires a certain investment, it constitutes real added value for all co-owners. It is indeed a complex piece of equipment, whose value is set to increase in the coming years.
